HARTFORD, Conn. -- Yale University denies it was trying to make an example of former basketball captain Jack Montague when it expelled him over a sexual assault allegation.The school filed its formal response late Friday to Montagues federal lawsuit, which accused the Ivy League university of punishing Montague over what he believes was consensual sex.The lawsuit, filed in June, argues the university expelled the popular athlete in February to prove it was tough on sexual misconduct. It also argues the school coerced the alleged victim into cooperating by inappropriately telling her about a previous misconduct complaint against Montague.The school admits that some Yale students and some alumni raised concerns about how Yale responded to complaints of sexual misconduct, according to the court filing. (It) denies that it had to show that it was willing to take a hard line against male students accused of sexual assault in order to dispel the notion that Yales campus was an unfriendly and unsafe.The lawsuit argues that the university used the case against Montague, a popular and well-liked athlete, in part as an opportunity to respond to a survey on sexual assault by the Association of American Universities. The association estimated that one in four Yale undergraduates had an experience that does not meet Yales standard for consent.In short, imposing harsh discipline on Montague would surely make an impact, the lawsuit says.A spokeswoman for Montagues attorney, Max Stern, said they were still reading the Yale response Saturday and were not ready to comment.Montague, a senior, was expelled after a friend of the woman involved in his case went to a school official who ensures Yales compliance with Title IX, the federal law designed to prevent gender discrimination in education.The lawsuit alleges the Title IX officer brought the complaint more than a year after the incident and despite being told the woman did not believe Montague heard her when she tried to end their sexual encounter. The victim eventually cooperated only after the Title IX officer informed her that Montague had previously received counseling after an incident involving another woman, according to the lawsuit.The lawsuit alleges the school didnt tell her that case involved him shoving a paper plate down someones shirt following a drunken argument outside a pizza parlor.The woman was not affirmatively misled by the defendants into participating in a formal complaint process initiated by Yale, the school said in its response.The allegation involved the last of four sexual encounters between the two students, his attorneys say.Police and the local prosecutor have said no criminal allegation was ever made against Montague.The lawsuit asks that Montague be reinstated as a student or for Yale to reopen the proceedings against him. But I also dont think its nearly as bad a deal as Bergevins harshest critics suggest.I also think we need to wait until Fridays opening of free agency to see what else Bergevin does to have a complete picture of how this team improves itself.As for the other blockbuster:If Bergevin thought he was getting it hard from his fans in Montreal, Edmonton Oilers GM Peter Chiarelli might have it worse, given the reaction of fans over his dealing of Taylor Hall to the New Jersey Devils for defenseman Adam Larsson.Which is why its interesting when I got this reaction from a Western Conference hockey exec about the Oilers making that move: Guys want a fixed cost moving forward, I dont blame them.That fixed cost is Larsson being signed for five more years at a $4.16 million cap hit. Thats a great contract as long as Larsson actually lives up to being a top-end blueliner.I think this is a solid acquisition by Chiarelli. Larsson is underrated. But at the cost of a bona fide scoring star such as Hall? Its an overpay by any definition.But if any team can overpay from one of their forwards, its Edmonton, another Western Conference exec said.The Oilers would have preferred to trade Ryan Nugent-Hopkins or Jordan Eberle instead for Larsson, but Devils GM Ray Shero had no interest in those players. It was Hall or bust.Of course, the Oilers talked to the St. Louis Blues about Kevin Shattenkirk, but they knew he wouldnt re-sign in Edmonton after his deal expires in a year. The Subban talks with Montreal never got to a point where it made sense for Edmonton.There are almost no defensemen out there for a trade, an Eastern Conference exec said, explaining why the Oilers deal for Larsson makes sense on some level.And its not like the Devils wanted to move Larsson.I definitely wasnt looking to trade Adam Larsson, Shero said over the phone Wednesday night. But I may never get a chance again to get Taylor Hall.Interestingly, when Shero and Chiarelli took over their respective clubs a year ago, they actually chatted and in some ways planted the seed for this type of deal. They recognized early on that the Devils needed forwards and the Oilers needed defensemen, and that one day they might help each other out.But they needed time to get to know their teams first.Shero and Chiarelli didnt really get going on this deal until the past week after they both reconnected in Buffalo at the draft.Shero, after being relayed the heat that his counterpart was taking in the wake of the trade in Edmonton, shed light on Larsson, a player whom most Oilers fans havent watched play much: I know one thing, if you look, Adam Larsson and Andy Greene had the toughest quality of competition in the entire league this year. And the worst zone starts. They were matched up against the best players every night. ...Adam is a heavy player, hes hard down low. Hes an unbelievable pro at his age. Hes an easy guy to coach and play with. Maybe people dont know him, but hes a good guy to build a defense around. Were going to have a hole there with him gone, for sure.But to get a talent such as Taylor Hall?
